  • Property--Tenants in Common and unpaid court settlement

    Some time ago I was a defendant in a property case (England) with my ex partner. The court declared us as "tenants in common", allocated a share to each party and a value to my share .A date was given to settle with an option to defer, neither party exercised that option. At the time I was driving lorries on long distance work and living in Scotland so the whole episode was really done by post.

    April 2013 sworn affidavit by claimant stating she was single and mortgage is up to date.
    November 2013 she married (I have a copy of the marriage certificate)
    2ndof June 2014 the General Form of Judgement or Order issued by the Court
    11 June 2015 the claimant passed away (I have a copy of the death certificate).

    26th January 2016 Grant of Execution issued to her widow in the High Court. (I have a copy of the Grant obtained from the Gov.UK probate website).

    There is no will relating to her estate, the only probate related document is the Jan 2016 Grant.

    As far as I'm aware her husband is still in the property


    I have downloaded Land Registry documents at least twice over a period of five years, both show the names of claimant and defendant. The property was purchased from the Council on a relatively short mortgage due to her age, she assured the court everything was up to date. It should have ended in 2015. I've since learned the lender has apparently gone bust.so the details of the state of the mortgage are a bit of a mystery.

    I have approached solicitors in the past but as soon as they learn she is deceased they tend to back away pretty quickly. In the last year I have had to come off work due to serious health issues and a life limiting health problem. I now want to pursue settlement and do as much as I can myself.

    Advice please.
