Our neighbour is having a loft extension. Scaffolding has been erected and is rather than resting on posts two sections are resting on two sections of roof on our property. We complained to the builder and agreed to have posts erected in our garden so that scaffolding could be raised above the roof rather than resting on it. After 4 days this has still not been done. We were not asked for permission for this scaffolding to be placed on our property. What should our next move be?

Call the council, the building inspector should be able to help. If it is genuinely unsafe council will stop work and force action.
The very nature of scaffolding means that it is temporary so any legal action you take would be pointless and a waste of money as the scaffold will be gone long before the wheels of justice started to turn. Take photos and check for damage once removed so you can claim if there is any.

If you cannot come to an amicable agreement with your neighbour & depending on how well you get on with your neighbour:
1) tell him to remove scaffolding from roof forthwith
2) charge him for placing scaffolding in your garden
3) if he declines obtain a court injunction (takes a week or two) and claim damages for interference with your property
If you have a dispute with your neighbour over this, remember if you come to sell you will need to advise prospective purchasers of the incident
