  • Close Brothers Finance Voluntary Termination Excess Milage Charges

    So I voluntarily terminated my PCP finance agreement with Close Brothers 3 years into a 4 year contract.
    They sent someone to inspect the vehicle and then sent me a bill for £2500 in mileage and £500 in damages.
    Whilst I agree with some of the damages, and willing to pay some costs towards them I am not happy to pay the mileage.
    The reason for terminating my agreement was because my financial situation had changed and could not longer afford the payments.
    From my understanding of The CCA 1974, Section 99 & 100 limits my liability for the vehicle and now I have paid 50% of the vehicle total costs, that should be it.

    I have used a template in the VT Guide as supplied by R0b and received a reply today to basically say they refuse my complaint and have advised me to complain to the Ombudsman if I still wasn't happy.
    What are my chances of winning? Based on Section 99 & 100 of the CCA 1974, I notice a lot of people are going down the mis-sold agreement route.
    Is this going to end up in court?

    Any advise of what to do next would be greatly appreciated.
