I made a claim through the small claims court (because a builder ran off with my money) and won the case and it was ordered that the money be paid back to me within 7 days. The builder has offered £35 per month which means it will take over 10 years to pay. I have refused this offer because I need to have the money in a lump sum as soon as possible to be able to complete the build and the court have called us back for a re-direction hearing. The information given by the builder on his application to ask for instalments was wishy washy at best when it came to his income and outgoings. What are the options the court have here and are they likely to empathise with me as living conditions here with a half completed build are intolerable, or the builder that says he doesn't have any money ?*
