  • CCJ from unknown parking Ticket

    I was made aware that I have a CCJ against me on my credit file due to a parking ticket sent to a previous address (I had had redirection but had not updated DVLA) I made co tact in jan 2019 and have started paying instalments, however I have now for. Research and feel it’s a good chance of getting it set aside (I do not want a ccj sitting there for 6 years). Is there a time limit of submitting the application to set aside? Many thanks

    As you have started to make payments, a court may take the view that you have acknowledged the debt and the CCJ and you have no reasonable defence or prospect of defending the claim. In this case they may refuse your application and you have lost 255 quid.
    It would obviously be up to a judge but my gut feeling is your application would fail.

      Regency Rolls v Carnell would probably stuff you too, under CPR 13.3(2) an application must be prompt, given you have been aware of the CCJ for 12 months and in Regency Rolls 30 days was considered too longer delay id say you may struggle as being out of time
