  • Letter before claim - parking fine

    Hello I am new to the site and have been doing a lot of research on my Letter before Claim received from VCS I received a fine for overstaying in the Berkerley Centre Shopping Precinct by 10 mins. I have appealed which has been rejected , as the same people who hear the appeal are the people submitting the Fine. My Argument is that this is a NON POFA fine and I have successfully argued the 10 min rule , however after my appeal it come down to an overstay of 2 Mins which is not detailed on the Original NTK. i have now received a Letter Before Claim.
    I would like to defend my claim . I would be grateful if i could be advised on my next course of action. I do believe i need to submit an SAR , is there anything else i need to provide at this stage thank you

    You have made an appeal, it has been rejected and now they have told you they intend to take you to court if you don't pay.
    So your next course of action is simple, wait for the court papers and prepare a defence based on your contention you are entitled to a grace period of 10 minutes.

      thank you for your reply . Wat about the SAR? , and I’m not sure wat u mean about a grace period of 10 minutes ? Not being legal minded I’m not sure your reply is very helpful to me .*

        I understand I am entitled to a 10 min grace period , however after I appealed they have narrowed it down to seconds and minutes which was not in the original notice to keeper . Do you think I have a chance of winning or an I wasting my time ? Thank you*

            I am currently fighting VCS fort NTK penalty notice . The NTK states 70 mins stay . The fine is for overstating 10 mins . I have argued the 10 mins grace period and now they have argued it’s 70 mins 22 seconds. The seconds are not shown on the NTK. I have now received a claim letter. The issue date is 3 feb 2020. This is a notorious car park in Sheffield and the judge has just thrown out all claims made by the defendant as the agreement with the landowner is for 2 hours free parking and not one . I will also be arguing this in my defence.VCS have consistently failed to provide a copy of the agreement with the landowner . I was just asking do you think i have a good case ?*
