    On what grounds does someone have to take away someone else's passport and refuse to give it back?

    None... you should not let your passport (which technically does not belong to you but to the crown!) out of your possession.
    I no longer have one so can't check, but there used to be a note in the passport which said it shouldn't be handed to an unauthorised person.

    It's your responsibility to keep your passport safe and nobody but you should ever have it in their possession unless it's absolutely necessary like getting a visa or other travel related necessities.
