  • Excel Parking - Letter before claim - previous letters ignored

I received a PCN in 2016 for parking in a car park connected to a gym, in the gym there is a computer log to input your reg. I assume that I had no put my reg in that particular day and therefore I received the PCN. I have ignored all letters (and not kept them) since then, until now. I received a Letter before Claim from excel parking stating that if I do not pay within 30 days they will take me to court for the fees and obtain a CCJ.

I have since spoken to the Gym assistant manager who stated (verbally) that they could email the company to get it obtains but when realised what company this is they then stated that the parking firm had recently changed and therefore cannot contact them. She also stated that the machine does not always log if you do put and if you have never received one in that area previous you should be ok to dispute.

I am wanting to dispute because I now have evidence I was in the gym on the times/dates they are suggesting and many other times and days. Neither them or I have evidence that my reg was not input. But I also have the issue that I have ignored this for a number of years.

The original fee was £60 which has turned into £160 and with court fees could be £227.

Please can anyone offer advice on what to do next or how to formulate an appeal letter against them.
