  • Brittannia Parking PCN - But I Had a Valid parking Ticket

    Hi,

    Our daughter received a PCN from Britannia Parking yesterday for an alleged 'Failed to validate stay' in a car park on 1st November. Luckily she still had the parking ticket in her car for that stay.

    Before she completes the appeal process on their website I just wanted to check if this was the best process or is there a better one that causes them maximum inconvenience yet still ensures the PCN is cancelled? Perhaps we can invoice them for the time we have had to waste in contesting this?

    Perhaps this:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    The driver has provided me with the valid ticket that was paid for and displayed, a copy of which is enclosed. There can therefore be no keeper liability

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

        I wonder if I could seek advice on their response.The original PCN claimed 'Failed to validate stay'. After sending a letter with a copy of the ticket they have now replied saying the PCN was issued 'because your ticket had expired? The original PCN has timed photos showing entry at 17:39 and exit at 20:09, the purchased ticket was bought at 17:55 and expired at 19:56 so technically this would be correct assuming their timings are accurate.

          So you appeal to POPLA with the usual unclear signage and the fact that they have not complied with POFA and therefore no keeper liability.Â*Â*
