  • Help needed regarding order of sale

    I’m hoping some can help us please?
    my husband is co-owner of a property with his ex- partner(never married). They have 2 adult children together (20+23). We have tried (and failed) on numerous occasions to contact his ex regarding the house. My husband wants the house sold and his name to be removed so we can purchase our own property. We have been renting for 10 + years. We have instructed numerous solicitors to help and each time we have run out of funds, as all that seems to happen is letter after letter is sent to the ex and she never responds. We are getting now where fast!. The ex ignores all letters and phone calls etc-we arranges (and paid for) mediation to get the matter resolved but she was a no show. Anyhow, over the last 9 months it has come to light that the ex isn’t paying the mortgage and has fraudulently signed my husbands signatures with regards to extra loans on the house and mortgage extensions. It’s all a real mess and is slowly destroying my husband. I feel absolutely helpless. I have today (again) after speaking to the mortgage company yet again, sought legal advice. We are looking at £5,000 to put the matter to the court to apply for an order of sale-this money we do not have-we have a 5 year old and ridiculous rent to pay (our rented house isn’t luxury by a long shot-but we are paying 4 times more than the mortgage payment). I have been told that we can apply to the court ourselves for an order of sale, but will need some legal knowledge to help us on our way. I have asked numerous solicitors if they will take fees out of the sale of the house (there is in excess of £90,000 in equity), but alas no-one apparently does this. I’m basically asking on here, if there is anyone at all with any legal knowledge that can point us in the right direction with regards to gaining an order of sale?? The delightful ex has made our lives a misery for the last 10 years and we now really need her out of our lives for good. I would appreciate any help whatsoever. Thanks for reading
