    Hi,

    i have recently been challenged on parking in a disabled bay at work. i have a historic back condition and i am under review for a blue badge. my employer has recently started challenging staff who park in disabled spaces without blue badges. Can they do this? Is there any kind of law regarding the size and colour of the space they are trying to enforce? i have recently been told they can't enforce the spaces unless they are yellow???

    Assuming the carpark is private and owned by your employer, they can make up any rules they like

      Have you told your employer that your application for a blue badge is in process? And perhaps remind him gently that he should be making allowances for disabilities, Equality Act. Not everyone with a disability has a blue badge.

        Depends!!!!
        If parking in these bays has been your habit over a long time you might now be able to claim it is implied into your contract by custom and practice

          i am currently under OHO, and physio review paid by the company and they are saying they have already made adjustments by changing my duties and until i get a badge then i need to park my van some where else.. I have only started parking there recently as my back has gotten worse
