  • MCOL issued Dean Clough

Hey guys - need some advice - I had an MCOL issued rearking. PoC are fairly incoherent. just wondered best approach to submit defense. I've acknowledge the claim and it was received on the 24/09/19. Date of issue was the 18th on the claim form.

PoC reads the "Defendant is registered keeper of car registration PE12PEN [redacted] Fiat Uno 500 Special Edition, Blue. [also redacted] Car registration PE12EPN was issued with four car parking charge notice on 30th April and 16th 17th & 30th May 2019 for unlawfully parking on private land owned by the Claimant. The Defendant was given the opportunity to appeal the car parking charge notice to the independent appeals service (Parking on Private Land Appeals) but chose not to and has not paid the car parking charge notice despite letters from the Claimant to the Defendant dated 23rd June and 3rd, 19th & 31st July 2019. The car parking per charge notice is £60."

Aside from the astonishingly poor grammar and spelling this individual has subjected us to, would a defense requesting case to be struck out due to error with PoC. The only true statement is the registered keeper part! ( and the letters part but I ignored all those). Is the fact they are stating the incorrect VRN where they issued the PCN to enough to get it thrown out/struck out?

    Thanks
    JB

So you ignored letters from the parking company? Not good advice

So is the VRM that you have given valid for the car that you are the registered keeper? Your story is confused about that.

can you post up one of those PCNs, suitably redacted , as a sample of what was received. Leave dates.

So you acknowledge the claim using the details and password on the form. Nothing in the defence. This gives 33 days from the issue date to get the defence to court

Thanks for your reply Ostell. Yes the VRM is correct for the car that I am the registered keeper. They made a mistake with the VRM on the POC.

I also have two receipts out the four where I did actually pay for parking.
