    A DOV is separate from a Grant of Probate - My question is this: Is a DOV legally binding and enforceable without a Grant of Probate?

    A Deed of Variation can be prepared before or after obtaining the grant of probate but it must take place within two years of the date of death of the deceased.
    If probate is not required (small estate, no property,stocks and shares) a DoV is still enforceable, but one wonders why it has been made.
