  • Parkwatch Parking Charge notice

    I have received a PCN dated 24/9/19. The issue date was 22/8/19. The reason they state was "Not parked wholly within bay" in a shopping centre. They state the signage is clear and displayed on site. They have rquested I pay 100 pounds other wise they will pursue me for payment. I did go to the shopping centre but always park within the lines. Please can someone advise on writing a appeals letter and whether it should be done via letter or email. They have not stated how long I have to appeal this charge. Many thanks

              They are hinting that there was a windscreen. Did the driver at the time tell you about any ticket?
              However:

              Dear Sirs,
              I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

              You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 8 (2) (e) of the Act.

              In addition you gave failed to give the information that must be given, as specified in 8 (2).

              You are referencing POFA paragraph 9. This is incorrect but if you insist that this is correct then you gave failed to deliver the notice within the relevant period of 14 days required by that section.

              You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

              There is no legal requirement to name the driver at the time and I will not be doing so.

              I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

              Yours etc


              Send so that arrives on day 28 so that they cannot reissue a compliant NTK within the relevant period

              They will reject but POPLA should accept.

                This was the first notice and there was nothing on the windscreen. I was shocked when I received it. Many thanks for this. I will send as soon as possible and let you know of outcome.
