    Hi
    OK so i have been caught on camera for doing 50 mph in a 30 zone in a Industrial zone at about 7.50 am on Thursday 27th June on a road that was quiet

    I received the notice to prosecute letter within 14 days which was all correct
    I presume I would need to go for mitigating/hardship circumstances
    I can only put the speed down to a momentary lapse
    I have been driving for 20 years & has never had any points on my licence at all
    The hardship circumstances are as follows
    I am a registered disabled blue badge holder & can only walk about 20 meters before I have to stop, I also cannot stand very well for long periods, so I need my car to get around in
    I could lose my job as I work about 45 mins from home & work different shifts between 8 am to 10pm
    I have 2 sons the oldest is eight years old and is diagnosed as autistic, so sometimes he has meltdowns at school & either the school or he can’t cope & needs to come home so i would be phoned first
    My second son is 1 year old & I look after him on Thursdays
    I have just received a Single Justice Procedure pack where I will plead guilty
    Regarding my circumstances do I need to provide proof?
    And could someone help me to draft a mitigating circumstances letter to the court. I’m planning to do submit this via the internet

      Don't despair you may be offered a speed awareness course means no licence points no fine You can plead mitagating circumstances that you describe to the court and take a chance. Problem may be you amount you were over the limit.

        50mph in a 30mph could be a short ban or it could be points - with a clean licence and no other aggravating circumstances then most benches would likely go down the points router rather than a ban but that would be up to the bench.

        It's not exceptional hardship as that applies where there's a totting up, what you're really asking is for them to apply points instead of a short ban. What you are wanting is to persuade them that points is more appropriate than a ban.
