  • Commercial Finance Against Property

    Hi, me & me ex partner own the home I live in and also a commercial property 50/50. He is setting up a new business and I think he may have secured a commercial loan against both of the buildings. This is without my say so as I haven’t signed or agreed to anything. Is there a way to check if he has? And also can he have done this without my signature? Thank You

      We are not on speaking terms. I am mainly wanting to know where I stand if he has done.

        You need to obtain the Land Registry documents for both premises to see if a lender has put a charge on the properties. You can do that on line.

          Thank you, I have located a registered charge on the information dated August this year. However is doesn’t state any further information. Do you know at all how I can locate further information?

            I am surprised that the land registry documents do not identify who the charge holder is. My suggestion, with that is that you contact the land registry, to request that it identify who that is.

            My second suggestion is that if the business for which the finance was raised, using the property as security for the loan (the charge), is a limited company, you look at the companies house register for the company, to see if the charge is mentioned there.
