    hello,

i am new to beagels and have a question.
can a credit card company regulated by the CCA, instigate court proceedings prior to sending a default notice? The consumer credit act says no, but im getting the feeling that, that wont matter to the judge.

I have a vague recollection that on Bailii, a case was recently decided on this, where the outcome was no need for notice - from memory claimant was young woman and the bank froze her accounts and and told her to take her business elsewhere.
