  • Good morning and thanks for taking the time to read

Thanks all for reading this and helping me deal with a situation I had hoped I could avoid. I feel a little anxious as a single lady, dealing with a builder, however I'm not going to be intimidated. I had some works undertaken by a builder who damaged my newly installed floor and I unfortunately was unable to resolve this with him, as he lied and then did not respond to my communication, including a LBA. I therefore had to commence a case via MCOL to which he has responded stating that he will defend it. The particulars of the claim I submitted did not list the full chronological details of the claim as there was not enough room to do this in the MCOL form and I'm a little anxious about this. My question is will I have an opportunity to provide this information and will not having done so in the particulars of claim be an issue?

You submit a witness statement just before (usually 14 days) the case itself. This is your chance to give your full story, preferably in chronological order.

Thanks Ostell, that's reassuring to hear.

My worry is that in the particulars of claim I only identified that the Defendant had breached the Consumer Rights Act 2015 by not carrying out his work with reasonable care and skill and very briefly why he had done so, however I didn't have enough space due to the MCOL limitations to write the complete chronology of what had occurred and how I had attempted to resolve things. Does anyone have any idea if I will be able to present this information at some point? Thanks

Why are you asking again? You've identified the cause of action, CRA, and the witness statement goes into the detail and expands, with exhibits.

Thanks once more Ostell for your reassurance. I was asking again as I wasn't sure that I was clear in my first post as to exactly how brief the contents of the Particulars of Claim which I completed was.

If there's an error in the dates I entered in the POC as to when the builder provided their service, will this have an impact on the claim? Also, does anyone know if I'll be able to take a friend to Court with me, as this man became intimidating when I spoke with him about the issues? As a single female, I'd like to take someone with me, even if they're not involved in the case directly. Thanks again all.
