  • No compensation for (extra) hours worked abroad

    Hello, please see a part of my work contract attached to this message.
    When i work abroad (EU, USA, Canada) i do not receive any compensation for extra hours worked. I do get my normal salary but I’m not getting any extra pay or time back for these hours. Sometimes i have 18 hours working days (travel time + working time) but the salary i get on my bank account is the same every month. I also don’t get any time back for the lost hours. My employer says that they can’t pay me any compensation for overtime nor give me back my hours by letting me take off time from work. Very frustrating situation and no success for me in in a meeting regarding this. Any help is much appreciated. Please let me know of you need any further information

    7.3 of the contract specifies, essentially, that you will not be paid for hours worked in excess of your normal working hours i.e. 7.5 hours per day, five days per week i.e. 37.5 hours a week.

    6.6.6. and 6.6.7 of your contract of employment defines the territorial limits of your work i.e. the UK

    So, you would be entitled to refuse to do work outside the UK and you would be entitled to refuse to work more than 7.5 hours per day - but not be entitled to choose to work only between 09:00 and 17:30

    So, what to do?

    Your contract does not represent the reality of your working hours. You could either try negotiating that, to reflect the reality or work to your contract.

    The employer cannot have your cake and eat it too!
