County Court Business Centre Claim Form

Hi,
I know there are so many threads regarding this topic, as I have read through them I have become more confused. Any advice you could provide would be greatly appreciated.

Recently a letter was received regarding the invoice which had wrongly been ignored. A claim form from the County Court Business Centre on behalf of Parking Control Management Limited who are using Gladstones Solicitors has been received.

The driver entered a Tesco car park which was full and parked up on the side of the road which is approx 20ft from the entrance to the tesco's which the driver believed to belong to the retailers. The driver had parked here numerous times before and there were always cars parked there. The driver ran in got a few bits and came back out. It appears that PCM had recently installed cameras to a residential flats located above the Tescos which the driver had not noticed. 2 seperate PCN's were received. The driver had not entered had not entered their private car park situated behind the tesco's.

What can the driver do from here? Do they need to return the acknowledgment form? The driver is willing to pay the original fine for the PCN's just to make it go away but not the greatly inflated fine! The driver definitely does not want to provide confidential details.

Any advice or further instruction would be greatly appreciated.

Yes you acknowledge the claim using the details and password on the form Nothing in the defence, nothing. This gives you 33 days from the date of use to send your defence to court. Ignore the court and you WILL get a ccj against you.

Have you still got the original PCNs. If so post them up here suitably redacted. What are they alleging the driver did to attract that charge?

It us not a fine, it is an invoice for a charge for breaching some parking regulation that you agreed to abide by.

edit your post so that the identity of the driver cannot be inferred

SAR request to PCM requesting all the information the have on you.
Letter to Gladstones requesting copies of all the documents that they will rely on in court in order to narrow the issues between you, as expected by the court.

photos of the signs, especially where the car was parked may be helpful

The SAR request has been sent and an email to the solicitors has been sent.

I have attached a copy of the 2nd PCN however 2 were received. The car park sign is the sign the car was parked next to. The camera is attached to the flats with the information and a sign further down that is not visible when the driver entered.

The Particulars of Claim:
The driver of the vehicle with registration xxx (the 'Vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract') at XXX on XXX, XXX, thus incurring the parking charges (the PCN's). The driver of the vehicle agreed to pay the PCN's within 28 days of issue yet failed to do so. The Claimant claims unpaid PCN's from the Defendant as the driver/keeper of the Vehicle. Despite demands being made, the Defendant has failed to settle their outstanding liability. THE CLAIMANT CLAIMS £100 per PCN, £60.00 per PCN contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £8.28 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at 0.07 per day.

Amount Claimed: 328.28
Court Fee: 35.00
Legal representative's costs: £50.00
Total amount: 413.28
