  • Premier Park Torquay Marina PCN

    Hello all. I received a PCN after parking in Torquay Marina on 1st July 2015. I had purchased a ticket for 2 hours and had returned to my car within this time but a friend I had met who walked back to my car with me was feeling unwell so I let her sit in the car until she recovered (she has a heart condition) so went about 15 minutes over my time. I appealed against the PCN giving this information and siad she could obtain a doctor's note if necessary and the fact that there had been a long queue at the ticket m/c when I arrived. The car park has cameras on entry/exit so they can link reg. nos. and times. I heard nothing more so assumed my appeal was successful. Now 4 years later they have passed the case to BW Legal - a debt collection agency and have increased the amount due from £100 to £160. They maintain that my appeal was never received and have given me until August 29th to pay or say I will be taken to court and more costs will be incurred. I have contacted local MP Mel Stride on this matter and he has written to both Premier Park and BW Legal but cannot advise me what to do. Unfortunately in the past 4 years I have moved house and mislaid any paperwork from the original appeal, and my ticket. BW Legal managed to track me to my new address despite a house move 3 years ago and a car change - DVLA I guess! Any advice would be welcome.

    They can't make a second request to the DVLA so the fact that they found you is all down to the tracing company.

    As they claim that your appeal has not been received I assume that the identity of the driver has not been revealed so edit your post and use "the driver ....." etc.

    As the keeper you will not be liable for the additional costs they have added.

    SAR request the Premier Park to get all the documents that they have about you. they have 30 days to deliver. Letter to BWL stating that you deny any liability in this matter as you appealed and did not hear back from Premier and take it that, according to the BPA Code of practise then if no response within 35 days then is assumed that the appeal has been accepted. Also ask, as they are threatening court, that they provide copies of all documents that they will use for that court case.

    I believe that Torquay Marina may be subject to Byelaws and therefore there can be absolutely no Keeper liability.

    Your MP may have inadvertently harmed your case if he has accidentally identified the driver.
