  • Private Road, Public Footpath Rights.

    Morning,

    Convoluted one to explain in a couple paragraphs and hoping this is the right Forum.

    I live on and face a private road which is also a public footpath (we are responsible for all up-keep and cost of maintenance of the road) which comes to a dead end with a small walkway for the public just outside of our House.

    At the bottom of the road it widens with a tarmacked area that is the width of a car/small van. Since moving in to the house we have asked guests to park there. Recently our neighbour has complained about this, saying it's illegal to do so (?). I was of the understanding that this was the whole point of the tarmacked area, why else would previous owners have gone to the expense of tarmacking a side-area of what is essentially a dirt road, if not for parking?

    I just wondered who's ownership this area was under? And what legal requirements you have with Private Roads when they are also public footpaths in regards to parking.

    Just to be clear, emergency vehicles could still pass around any cars parked in this area, and the tarmacked area doesn't hinder any access to any of the 3 households on our street.

    First place to start is Land Registry to see who owns that piece of land; https://www.gov.uk/search-property-i...-land-registry
