  • Speeding Offence - Mitigating Circumstances?

    Really appreciate some help with this issue.

    I had a speeding offence a year ago (70 in a 60) on a motorway and took the option of attending the speed awareness workshop for motorways. Matter was then closed and my license is totally clean.

    Recently I was at work and my wife informed me that our aged family dog had collapsed at home and wet himself. He had been struggling to get up and around for some months and we knew his time was coming, and with this latest issue, we knew the time was now, and my wife arranged for the vet to come to our home. Knowing that he was possibly in pain, I left work immediately to get home to be with him before he was put to sleep in our home in an hour's time. On the way home, I was caught speeding on a dual carriageway (74 in a 60).

    I've just received the summons, offering me to pay £100 with 3 points, or to take a speed awareness course (I'm not sure if I am still eligible for this given that I did the motorway version last year). My question is, given the mitigating circumstances that I wanted to get home urgently to be with my dog before he was put to sleep, I am considering going to to court to explain this, as this appears to be the only way in which these circumstances will be considered.

    Firstly, what is the likelihood that the case may be dropped considering the circumstances and secondly, if I do lose, do I pick up the additional court costs or will I be offered the speed awareness workshop again?

    Greatly appreciate any help anyone can give here.

    If you elect for the Speed Awareness Course the authorities will check your eligibility and then say "No...only one in a three year period"

    I doubt that your reason for speeding would be accepted as mitigating circumstances, and if you opt for court you will likely end up with an increased fine.
    No matter how great your attachment to your dog, i doubt a magistrate will view the circumstances in the same way
