we are tenant of an HA and live next to an owner who rents out privately (to his brother in law). We have suffered from a leaking Heating oil pipe belonging to the next door neighbour but in our garden on our boundary. Our landlord waited 6 months before contacting our neighbour for the first time, never approached EH even though we sent him videos of the pipe dripping, the oil seeping into the soil just 2metres away from the French doors to our bungalow bedroom which would steam on hot days. We couldn’t sit in the garden, if we had the windows open the bedroom would stick of oil fumes. My husband has Copd and also sleep apnoea and the Cpap machine was pumping these fumes direct into his lungs. I have asthma and had a tumour removed from my chest some years ago but my breathing has also been affected.
our landlord let us suffer for over a year before the next door got the pipe fixed and even now it still stinks because the oil has seeped Into his foundations. When I asked our landlord a couple of weeks ago if he owed me a duty of care he said no, we are only a provider, any health issues you and your husband have are between you and the owner next door. It’s a private matter. There is also. no fireboarding in place to prevent the tank which the neighbour has put against my fence combusting. When I told the landlord he again said that’s something you need to sort out. I said but it’s not my property this is your property and he said yes but you need to sort it’s between you and him. I don’t believe this is right. We also had our neighbours boiler discharging into our air bricks for 10 years before anything was done. We had to seal the air bricks in our wall with packing tape and even now our front room still smells. We have and are so ill from this yet no one will help us. Can we sue?
