  • Misrepresentation of information during house purchase

    • Service maintenance check list (attached) from a Heating Installation company on boiler of house to be purchased dated 06/12/2018 included the words “All Ok” so I believed the boiler to be functioning properly, however 7 weeks later when I took occupancy the boiler was not working. 3 independent parts needed replacing at a cost of nearly £600- clearly uneconomic.
    • I had to pay £1500 for a replacement boiler and installation from another company
    • On closer inspection the service maintenance check list, which was in triplicate carbon form, had words erased. The Heating Installation company place the responsibility of the erasure on the vendor stating he also dishonestly added “All Ok” In addition they said that they had been telling him for 2 years that the boiler needed replacing.
    • Do I have a potential small claims court case against the vendor?
    • Do I also have a potential small claims court case against the Heating installation company? They issued a written service report which misrepresented the condition of the boiler so leading me to believe it was functioning properly thus negating my opportunity to negotiate with the vendor an appropriate reduction to the house purchase price. Although they are blaming the vendor for the misrepresentation they have admitted that their gas operative who carried out the boiler service was later dismissed for general GHS Service doc.pdf incompetence. They have also accepted that the erasing of the words was overlooked by said operative and also by their office.
