    we took a secure loan against our property in 2003 we paid off in full in 2006 by remortgaging with the current provider at that time however it appears the charge has not been removed from the land registry only come to light as we are in the process of remortgaging can anyone advise

    When you redeemed the loan the lender or their solicitor should have removed the restriction.
    you should contact them now and ask they remove it

      Thank you the trouble with that this was 13 years ago soI have no paper work however we can pay our solicitor additional fees and they can request to have removed

        That's odd.. all that is needed is for the finance house who registered the charge to complete form DS1 which " acknowledges that the property identified in panel 2 is no longer charged as security for the payment of sums due under the charge"

        If they no longer have any record of the loan there is no need for them to maintain the charge.

          The problem with that is the lender is no longer doing business. We are talking over 13 years ago. We know the loan has been paid as our mortgage company paid this off when we remortgaged. I don’t think we are going to have a lot of choice but to pay a solicitor to get this removed

            The lender might not be "doing business", but that doesn't mean the company no longer exists.

              How do I find it as I google it and it no longer a company not sure what to do
