        Hi Petronella,
        Welcome. You probably need to give us a clue really. If you give us a bit of background about your issue and ask what it is you want to know, someone should be along who has experience in the particular area.

          Thanks so much for replying! I'm not sure whether you've seen my previous post outlining my problem- but here it is.
          I have very recently discovered that I was missold a life insurance policy by HSBC 20 years ago. It is clear to me that they deliberately deceived me and I have complained to them and requested they refund me the premiums. They have refused to do so and have dismissed my complaint. I wish to issue a claim against them for the missold premiums but am afraid they might take the opportunity to issue a counterclaim against me for a completely separate claim they had against me (for twice the amount of money I would be claiming from them incidentally) back in 2008. Their claim against me is now statute-barred and was in-fact struck out of court 9 years ago for non-compliance with court orders and directions. Given that their mis-sale to me pre-dates their separate claim against me - even though I have only recently become aware of it - I am concerned that they will seek to revive their claim and that I could end up owing them money. Do you know if there could be any possibility of the courts allowing them to revive a statute-barred claim? Obviously any counterclaim they could make alongside their defence to my claim against them would be on the same piece of paper and might therefore become mixed-up and have the effect of reviving their old claim against me? Any light you could shed on this would be enormously welcome Peridot! Thank you again for replying. Best regards, Petronella

              Sorry, not my area so can't really advise on this. The only thing I would say is you would have to prove the life insurance was missold. Is this a PPI type claim where the insurance has been added or encouraged when it wasn't needed or a seperate life insurance policy?

              The person with probably more knowledge is away at the moment but hopefully will be able to give some pointers on her return at the end of the month.

              I'm not sure if you can change the title of the thread so it gives people a clue what it is about maybe mis-sold insurance issues or some such. If not don't worry we'll find a way.
