  • MBF VT received a County Court Business Centre Claim form Nottingham?

    So after nearly 19 months receiving threatening letters from Mortimer Clark Solicitors acting on behalf of Mercedes Benz Financial services over a VT claim for excess millage "Which i have contested throughout", I have received this morning a Claim Form from County Court Business Centre in Nottingham? This came as a surprise because the last Mortimer Clarke letter i received clearly stated County Court action would be the next step....!!!

    This letter doesn't look right to me. The Form, Coat of arms stamp and the crown clearly shows its a photocopy "No ink stamps"? I get the impression they are trying to bypass a court hearing which i am happy to attend as without going into to much detail MBF didn't follow the own VT process correctly and made a number of mistakes.

    Anyone with any knowledge or can offer advice on this matter would be much appreciated.

    Northampton is the "clearing centre" for County Court claims. It will eventually move to your local court later in the process. It's a not very convincing form.

    Acknowledge the claim NOW using the details and password on the form. This gives you 33 days from the date of issue to get your defence to the court

    Logging in may convince you that it's real

      Post up the particulars of claim word for word.

      What's the claim for excess mileage? If so how much excess mileage and what's the cost

          I have attached the detail outlining my case. Timeline of events and supporting docs.

          Would really appreciate your views.

          To date i haven't had any more correspondence from Nottingham business center

            What is the date of the claim form (can you upload a redacted copy of that)?

            Have you acknowledged the claim?

            Have you filed a defence yet?

              Hi Rob

              Date of claim from MBF through Nottingham Court Business center 25 April 2019. After receiving the claim form i responded with an acknowledgment of service defending all of the claim made against me using www.moneyclaim.gov.uk.

              I checked progress yesterday on the above named site and there is no other entry made after my initial response (site allows you to track progress as im sure your aware)

              Waiting on MBF/Courts next move, I haven't been asked to file any defence as yet.

              Really unsure if there is anything more i should be doing?

                When a claim is issued against you, you have 14 days to file a defence. If you acknowledge, you are given an extra 14 days which makes it 28 days + 5 days from the date of issue of the claim form.

                You shouldn't be waiting on the court of MBF, you should be filing your defence or risk a default judgment against you.

                Based on what you've said, I am assuming you've not done anything so you might want to get your skates on and draft a defence. Happy to feedback any draft if you post it on here but you need to get on it asap.
