  • Long time lurker with a UKCPS problem.

    Hi everybody, our car was recently parked in a retail park disabled parking bay.Unfortunately it seems we forgot to display our blue badge.

    We received this letter from UKCPS saying we had to pay £60 within 14 days or £100. We are both obviously physically disabled and have problems walking.

    Can we defend this at all, any advice would be most welcome.

    I take it there wasn't a windscreen notice to driver?

    The postal notice to keeper is defective, as there is no period of parking shown on it.

    Answer my above question & I can give you chapter & verse.

        9(1)A notice which is to be relied on as a notice to keeper for the purposes of paragraph 6(1)(b) is given in accordance with this paragraph if the following requirements are met.

        (2)The notice must

        (a)specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates;

          Thank you for that information.

          Do I now reply and tell them to go whistle, or ignore it. Out of interest, is the fact that they have named the retail park but not given its location relevant?

              Thanks for the information. I'm not sure if I'll reply, however if I did reply saying why I shouldn't pay, are they likely to go to court. If I did reply how would I word it please'

              According to Google there is a retail park with the same name in Newcastle

              It's good to meet Fred Fernakapan, it takes me back to Tiffany's night club in the 70's' Me strutting my stuff to the disco music in my flares and platforms, sans hairy chest and medallion. (Yes I am that old)

                I'd just refer to the recent notice to keeper & state that it is not compliant with Protection of Freedoms Act 2012 Schedule 4.
                Don't send it till close to the 28days (SeeNtK)

                    I too have had a problem with UKCPS & perhaps you may find the info below of interest.which I found of DirectGov website. Off-street car parks

                    The Blue Badge Scheme does not apply to off-street car parks, for example supermarket car parks. However, off-street car parks may provide bays for Blue Badge holders. Please check with notices before parking.

                    Apart from local council car parks, most are likely to be privately owned and managed by the individual business.

                    In a local council car park, it is normally an offence to park in a disabled persons' parking bay without displaying a valid Blue Badge. Drivers who misuse such spaces may also have to pay a penalty charge.

                    There is a difference in privately owned car parks. Charges and conditions of use in off-street car parks are a contractual matter between the car park owner and the motorist. Enforcement of disabled persons' parking bays is therefore a matter for the individual owner or operator of the car park.

                    If a non-disabled motorist parks in a disabled space in a private car park they can be asked to leave. But it can't be legally insisted. For instance at a supermarket, an employee can ask the driver to move their car from the reserved space. But they can't legally insist on it.
