  • Rejecting a used car

    Hi I’m new here, I hope someone can help. On I bought a 2 year old car from a second hand car dealer (a main one with nation wide branches but not specific to a make of vehicle). I drove it for 2.5 days and travelled 68 miles. I had already thought the engine was getting increasingly noisy over the 2 days post purchase and then on the third day the car suddenly started juddering and stalling, shaking and the engine warning light started flashing, and the start stop warning light came on. Luckily I was just in the road approaching home so I was able to make it to my driveway. Each time the vehicle engine is started it shakes and judders and is loud!! , its obviously not right. I Immediately wrote to the dealer the following morning setting out the problems and asking them to collect the vehicle and discuss the next steps. They were quick to recover the vehicle on the same day and give me a courtesy car also on the same day. I agreed they would book the car in for repairs under warranty (the car is just 2 years old and I’m told by the dealer that it’s still under warranty but I wouldn’t know as they didn’t give me any paperwork at all on purchase). They told me the car is booked for diagnosis and repair in a weeks time. BUT this has really made me sceptical about the car and why this has happened. There’s a really dodgy spray paint job on the nose of the car and I am now concerned that it’s been involved in an accident and there are problems due to this. I have now decided I don’t want them to attempt to diagnose and repair, I want to excercise my right to reject and a full refund. Is this reasonable? I haven’t made reference yet to the obvious spray paint at the front. Should I mention this? What are the next steps to reject? Do I have a good case? Any advice please? Many thanks.

    Hi and welcome

    As you have already agreed the dealer can attempt a repair you have lost your right to reject the car at this stage.
    As they have collected the vehicle and left you a (free?) courtesy car it is being done with as little inconvenience to you as is probably possible.

    IMO you will just have to wait and see

      Ok thanks for your help. I only know as much as I’ve googled so far but I did think I still had the right to reject at this stage

        Tha act is quite clear on this point:

        Consumer Rights Act 2015
        Sec 23 Right to repair or replacement
        (6)A consumer who requires or agrees to the repair of goods cannot require the trader to replace them, or exercise the short-term right to reject, without giving the trader a reasonable time to repair them (unless giving the trader that time would cause significant inconvenience to the consumer).

          But the 30 day clock stops while they have the car so if the same fault reoccurs within the 30 days it has been in your possession then you can reject.
