  • Energy company late billing court action

    Hi I have just received a county court MCOL action for a final bill from an energy company dating back to September 2015
    I sent the original invoice back because it didn't contain addition that supported the figure claimed - over £1000 and also went backwards and forwards in time periods encompassing five years.
    This is the first I have heard of it until this year when the solicitors they are using did write to me by non-registered post to say they were about to take action but they have not sent me an invoice or a statement.
    (I still have the original invoice). I have spoken to the court and they won't remove the case. I have put a copy of the letter I sent in 2015 as my defence which says as above simply invoice returned as it doesn't add up.
    Could you give me any advice as to how to proceed now? ( I have agreed to mediateion but not heard if they have)

      You need to explain fully about this - saying "I sent the original invoice back because it didn't contain addition that supported the figure claimed" means nothing.

        Oh okay right thanks I understand i need to spell out the issue with the invoice I will do
        That's really useful thanks
        They didn't send me a statement
        Isn't there some legal advice that statements have to be sent before action?
