I desperately need help with a working tax query if anyone can help please. Basically I have an overpayment of 5k for tax years 2011/12. I was claiming working tax credit whilst trying to set up in business on my own. This wasn't working very well and I couldn't get it set up, but was allowed to claim wtc. I was being paid etc, and received all my notifications of what I was going to get etc including a letter dated 6/9/2012 . Then on 17/9/2012 I received a notice that I was not entitled to wtc and had an overpayment of 5k for that year, but they would not be collecting back ATM. I have made many calls to them asking for an explanation of this, and all I have been told is that compliance had said I was high risk, but no explanation to what that means. I Have contacted them on several occasions asking for this explanation, even this year, but no one can tell me anything. I requested all paperwork, and received over a ream of paperwork from them and a cd which was supposed to have all my calls, there is only 5 calls, but a very interesting one where the lady on phone says that she can't see why they have done this and it's looks like there has been a mistake. I have since split with my partner and have to claim universal credit. My payment went down suddenly without any warning of 80 per month and when I contacted them I was informed it was done by tax office to claim back the 5k overpayment. They had split it between my ex and myself, so they are looking at 2.5k from me. I contacted them to say that I didn't know about this as it has been years since this all occurred and that I could not afford 80 per month, and am now paying back at 20 per month. My questions are, am I still liable for this as it's over 6 years ago, and secondly should they not have contacted me first before just taking money from me. It's all so very confusing and any help will be so much appreciated. Thanks guys x
