i bought a pay and display ticket at my local staion which i think has just changed hands to NCP. The tickets are not the ones that stick to your windows and have to be placed on the windscreen. The machine also registers your Registration and i was previously informed that this was sufficient and that NCP recognise this. The day in question was the windiest day of the year so far and i had to return to my car to retrieve my wallet and the ticket must have blown off the dashboard. I have contested with NCP and they have rejected. i supplied images of the ticket. Will i now need to pay or should I appeal to POPLA?

There is lot of controversy regarding private firms issuing PCNs on railway land.
Normally, land governed via Byelaws is not 'relevant land; for the purposes of the legislation governing private parking co's issuing PCNs.(Protection of Freedoms Act 2012).
But very recently, the DfT & POPLA decided that it was ok to do so.
There are many groups who disagree with this stance, & I guess that only a court will have the final say.
Clearly, unless there is some good reason why the PCN can be cancelled (ie they've messed up with time/dates/site loction etc, you have to make a judgment call whether or not to take the normal appeal route. Ie parking co, then if if that fails, POPLA (which as indicated has stated it's position re railway land.)

Please see attached the ticket and the PCN. I will get some photos of the site signage tomorrow. Please note that I have noticed that it states that "no other cashless parking payments detected". I have been reliably informed by one of the wardens at this station that due to the machines at this location requiring your numberplate before issuing a ticket the data is recorded and available to the wardens.
