Hi I am looking for some guidance re an invoice received from a PPI company. I received a payment from Santander and paid the claims company their part. The claims company advised there was no further information re any claims and I should call the company to get them to investigate their archives, I called the company at my cost (from another country).
I am in another country so called the company in the UK and went through all my past address and asked them to investigate if there was any PPI on the phone for over an hour (costing me) Santander also at that time told me there were " no cases set up already for me" so the claim company had not registered anything other than the claim already paid out with them.
The claim company chased me to sign a letter of authority for a card they believed there was PPI on but as I had already spoken to Santander I didn't sign any letter of authority for them to investigate further. They claim that because I signed a letter of authority for "Abbey' that gave them the authority to investigate all connected accounts - Santander took over Abbey in 2009. Their response is "Please be aware the letter of authority attached confirms you gave us authority to look into any account you held with that lender"
Subsequently I received a payout from Santander direct for the investigations I had asked them to do.
The claim company called me to return LOA paperwork (by now for the claim I had already received) but I advised them that I was not going to continue due to the cost of me having to make calls to the UK and having to send "ink on paper" return paperwork via DHL which is also a cost to me (postal service takes months from where I am).
The PPI company now say I have to pay them for work done - when I didn't sign a letter of authority instructing them to carry out - and are charging me £180.00 for "Customer & Lender Fees" = £50 for pack issues, £30 for Lender Group Data Requests, Claim Fee - £30 for Data Response Processed, £40 Questionnaire Pack issues plus VAT = £180.00 ....I believe most of these charges are for pressing a button on a computer.
I didn't request that they investigate this claim for me so cant really see why I need to pay them when they did not do the work, I have also spoken to Santander this morning and they said that the claim company had not sent them a Letter of Authority neither have I given them (Santander) authority for the claim company to investigate the particular account. Santander confirm that they received paperwork relating to one account number from the claim company and did not request investigation into any other accounts. They have advised me that legally the claim company can only request that they investigate into the info given with a LOA from me to them (Santander).
My problem is I have a care of address in the UK and I want to challenge them but obviously don't want to affect my friends address in the UK but I feel its unfair when I have incurred costs to gain the payment myself Santander have agreed this with me that they did not have any other cases or requests and now the company want me to give them a Letter of Authority or pay them for the work they have done without my authority claiming the Abbey LOA gives them the authority to do this.
The claim company also just came back and said that the other Letter of Authority I signed for Abbey - not Santander gives them the authority to look into any account from the Lender, but Santander, the Lender says different? It says on the top of the signed Abbey LOA "The Information below is to identify the customer. Additional accounts identified by your lender using this authority are also covered by this document" ....
