I've just received a charge notice from CP Plus. Apparently I exceeded the free parking period and payment was not received. I only spent time in the services (MOTO) and did not leave the site. What action do you suggest I take?
I have 14 days before the charge increases from £60 to £100

    Hi

First things first.....have you been in contact with CP Plus at all? If so, have you ID'd who was driving at the time? (Yes/no)

Was there a windscreen PCN issued at the time? (I'm guessing not, but it pays to confirm.)

Can you post up a copy of the postal PCN? (Front & back, redact personal info, but leave all times/dates visible, please.)

& have you/can you take pics of the site signage.

    Btw, was it at Toddington?

      Hi,
I have not been in touch with CP Plus at all, so they do not know who was driving. There was not a windscreen PCN. Please find attached a copy of the postal PCN. I don't have any pics, but there are some included in in the PCN.

      It was in Swansea.

I could take more photos if necessary.

      Thank you for your time.

Edit your first post so that the identity of the driver cannot be inferred. Use "the driver....."etc.

        Here's an appeal:

        Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

        Yours etc

If you appeal on line make sure you take a screen copy of all pages and keep them. Make sure you appeal as the keeper.

If by mail then first class and get a free certificate of posting from any post office.

As ostell says, it's important that the driver's ID is not revealed. (Even by inference,)

Refer only to "the driver.....", "the registered keeper.....".

          & please edit your post(s).
