  • Hi considering small claim court advice needed letter before action

    Hi
I'll try and keep this short. Over a year ago devastating under ground water leak extensive damage to fitted furniture and solid wood floors. Used Zurichs (home insurers) contractors for remedial work. Very shortly after work finished floor in kitchen started to fail. Contractors came back cut hole in new floor removed skirting and plinths around kitchen. Put a hygrohood down and said floor had no damp proof membrane and we had been advised of this. They walked away leaving my kitchen in horrible mess.Totally untrue about DPC and since previous wood floor had been down for nearly 20 years don't believe this contention for one minute. Floor is starting to fail in other rooms in dining room cant open door flooring is so warped. Decided to go to ombudsman about 8 months ago still waiting for an investigator to be appointed have been told that it will still be quite a while. Meantime I;m sick of waiting just want my home back to where it was. So am now considering legal action.
Question 1.I will have to get my own expert report do I need to have agreement of Zurich? asked them to jointly fund an independent report months back they said they will do nothing until ombudsman result..
Question 2. Letter before action in my case covers goods and services via contractors employed by Zurich my insurers. I assume it is Zurich I need to pursue but have do idea of wording for letter.
    Any help gratefully received.
