  • Public Auction on Private Property

I'm suing the Trucking Company who the I.R.S.Â* / Treasury Agent man said he told him (hear-say) to tell me that he did, that he didn't want me on his PRIVATE Property and to get off under threat of Criminal Trespass as backed up by 2 of the 3 local (Nashua, N.H.) COPs there too on Police Detail that I complained in person at The Police Commission that of they all violated my right of free speech and assembly.Â* Now the MAYFLOWER MOVERS (McLaughlin Transportation) man has just today by the E-filing filed a Motion To Dismiss by his attorney because of that his boss having PRIVATE PROPERTY rights that somehow over-ride a contract with the Feds to OPEN their gate to ALL, but except for me somehow Ex-cluded from being a member of the public!? I'll post the case law he cited for Private Property rights, but what about the obligation of contracts? The Police Commission said that whoever orders The Detail is the one-in-charge of you do what he wants: or else!Â*

Here's what the attorney wrote on pages 2 + 3 of 5: "Â*a. It is axiomatic in tort law, that a tort occurs only when there is a harm. Porter v. City of Manchester, 151 NH 30, 38 (2004)(“[t]he fundamental difference between tort and contract actions lies in the interests protected. Tort actions protect the interest in freedom from various kinds of harm.”). See also McBride v. Huckins, 76 NH " / "Â*206, 214 (1911). Cate v. Cate, 44 NH 211, 214 (1862)(injury required for civil trespass claim). " - - - - - I think that he's trying to get me away from his contract of to OPEN it up to the Public-AT-LARGE!Â*

. . . on page 4 of 5: "Â*8. Trespassing Mr. _____Â* from private property, if this did occur, is the exercise of an elemental right of private property ownership. In fact, barring the people from using private land is so elemental a right that it is enshrined in Part I, Article 12 of the New Hampshire Constitution. See Opinion of the Justices (Public Use of Coastal Lands), 139 NH 82, 87 (1994)(striking down a law that allowed public use of privately owned shoreline land). "Â* but as I said of that when he contracted with the Feds of The Government, he made himself a party-in-the-second degree.Â*
