  • Just joined. Looking for County Court Money Centre advice

    Ive just joined as I really need massive advice. Looking to take a Car Company to the small claims court. I’ve tried all dispute resolution options but the business just won’t respond. Any advice appreciated.

      Yes I've done nothing but research all day. My case is unique though. Not one you see everyday

              I'm afraid if you want any meaningful help you are going to have to give us some background. You say that your case is unique but as you are looking to take a car company to court I'm wondering whether it really is just a simple breach of contract claim?

              Either way, we will need some info on what the issue is, what you've done so far to try and remedy the issue, what responses you have had from the car company (if any) and what remedy you are seeking from the car company.

              Without the above, you are only going to get limited and speculative help.

                I rented a car from a car company MA Car Group, April 2018, it was their own rent to buy scheme. 3 year contract. £60 pw. By the end the car would be mine.

                1. They was responsible for the car tax. But they only paid 2 months. I've paid the rest since.

                2. I never signed a V5 but somehow a log book ended up in my name to my old address (luckily I know who lives at my old address).

                3. A payment was never missed. In October 2018 the tenants who live at my old address rang to say their was a man with a tow truck ready to tow the car. I was suspicious. So I rang the number he left. He was from Grosvenor Money Investigation. He said the car wasn't ours. I explained we rent to buy from a car company. He said we'd been done over. I was told to ring another car finance company called The Car Finance Company.

                4. I rang The Car Finance Company who said my vehicle belongs to them and not the company were renting from (ma car group) So I rang the company I'm renting from who said the car isn't financed to anybody else. I have a copy of the HPI which states The Car Finance Company has finance to the car not ma car group.

                5. I contacted citizens advice. They advised me to contact the financial ombudsman. I did. I also emailed ma car group to say they have no entitlement to this vehicle to rent out under a rent to buy.

                6. Ma car group refuse to send me my contract. Despite many emails and phone calls of complaints about this.

                7. The car finance company who the car actually belongs too say the vehicle is now classed as stolen. I had to email all my correspondence between me and ma car group to prove to the car finance company that ma car group had this vehicle as they've denied all knowledge of having the vehicle.

                8. Ma car group have never responded to me over this matter. The car finance company are building their own case on this.

                9. Ma car group have not responded at all to the financial ombudsman. They want to see the agreement to see if they can take the case on.

                I'm at a standstill with everything. I stopped payments to ma car group when I found all this out in October. I paid £1650 in weekly payments. £158 deposit and I've done all repairs and Mot too. But if it wasn't for me having a new address the car would of been towed away.

                I've asked for a refund. Payments where made via standing order. And I've kept all my receipts.

                  I've sent email after email to ma car group. Always ignored. Citizens advice contacted trading standards. I contacted the FCA. Financial ombudsman. Been in talks with the company who it does belong too. Ma car group just won't respond. I've written an action before court letter today but not sent it off yet.

                    It sounds like this "rent to buy" scheme is really a hire purchase agreement. I've looked at the M A Car Group website (https://www.macargroup.com/) and it suggests that they are a licensed credit broker, not a lender.

                    If M A Car Group are not responding, then the only way is to issue legal proceedings against them, do you mind posting up your letter before action so we can see what you've written?

                      They’ve responded to no one. The only person they’ve responded to is ‘The Car Finance Company’ to deny knowledge of the vehicle. Ive tried to upload the letter but it says the file is to large.

                          You might want to try and compress the file using an online file compression service. Or you if you are taking on your phone then you might want to look at lowering the resolution of your photos.

                          If that fails you can email admin@legalbeagles.info and I'll tag Amethyst who should be able to help.

                          There's no offence committed because this is a civil law matter, not a criminal one. There are ways of forcing the company to disclose the contract but it will cost you around £255 to do so and an application to the court. You might be better off taking the company to court and relying on their lack of response not just to you but also the Financial Ombudsman and anyone else involved.

                            Ill email it. You say it’s not criminal but surely it is? The company who has interest on the vehicle states it’s a stolen vehicle in their eyes. Its all complicated and it’s done nothing but stress me out. How they can do this to people is beyond me.
