Hi everyone, just a quick question. I had a visit from a Marston baliff for a £1200 court fine for a driving offence in aug 2018 now I live with my mum at the mo and own nothing in the house bar my room. Are they able to take any thing if I am able to provide receipt s for the most expensive assets. And also when I wouldn't grant entry he rang a lock Smith, police sat in his van for 20 mins and drove of and haven't heard anything since. This was about 3days ago. Any advice would help many thanks. oh and also started by telling me he had a warrant for my arrest ant the fine was for criminal damage which I no is incorrect

Did you attend Court?
Did you submit a Means Test form?
What letters have you received from the Court prior to this?
Have Marstons sent you a Notice of Enforcement prior to this visit?
They may only seize goods belonging to the debtor but if you are living at your mums they may insist she provides receipts for all her goods.
The Warrant they have confers the power to force entry if they believe you are being obstructive. Phoning locksmith & police is a common practice hopingit will ramp up the pressure to get you to pay.

Thanks for the reply ploddertom. Yes I attended court for which I received a driving ban and the fine in question I think I received a reminder from the courts as I was between jobs. When I rang the fines office they told me it had been passed to ballifs but I'm sure I received no letters from Marston. Now I'm sat here wondering what they gonna do next as they just dissaperad leaving a notice of inntessions to enter the property. Thanks again

You should have received a Further Steps Notice from the Court warning that if you did not pay or make a suitable proposal then one of list of steps they could take would be invoked - this could have been the letter you received.. As for the Bailiffs then they are supposed to send a Notice of Enforcement giving a timescale to get in touch before a visit would take place. I would hazard a guess at present they will have added £310 in charges to the outstanding fine. I would also guess they sent the Notice to an old address - I assume you did not live at your mum's address when this all blew up. I would suggest if you have not been given/sent the Notice of Enforcement then they cannot go ahead with any enforcement until they do.
If you have had a change in circumstances re your income I would suggest you contact the Court Manager or Fines Officer and ask if you can provide another summary of your means. You would need to do this ASAP - like tomorrow. If they will then also ask if they will contact Marstons to suspend enforcement in the meantime.
