  • bailiffs to evict MY BOAT from trespass on national trust property !?!?

    i’ve been visited by bailiffs. they mentioned “WE HAVE A COURT DATE”; before i locked the door and told them to go away (not the exact words). they then taped the bits of paper they wanted to give me on the outside; and went away. no mention of a court date at all on papers. just a scare tactic.
    here’s the thing. i live on a boat; tied up in the mud; on the torridge estuary in this place for at least 2 years. the land that im sitting in the mud ADJACENT TO belongs to the national trust. whether its them; or the farmer that leases the farm from them; i dont know. ; but im being accused of TRESPASS, MY BOAT.. sitting in the mud. which belongs to crown estates. the queen. and moreover; a boat’s right to tie up/anchor... not permanantly moor....is inviolate in this country. i have that in a book produced by a barrister that is also a yachtie. AND this part of the estuary has been granted free mooring in perpetuity some hundreds of years ago. it seems to me ,,,they are bluffing. and OUTSIDE THE LAW. i need help. i would; and will ignore this. with precautions. i think they cant break in or steal anything that is locked down. also; i know that maritime law takes a VERY DIM view of unwanted persons TRESPASSING on even the deck of a boat. very serious stuff. real judge. real prison. BUT.... A NEED MUSCLE. I NEED AN AUTHORITY TO BACK ME; AND SEND THEIR OWN LETTER stating the obvious; and telling them stop...and apologize.i want an apology. i live on my boat; creating 1/4 thecarbon footprint house dwellers do. i break no laws. im 63; semi retired; and on poverty wages/.... im not doing anybody any harm. please advise. a book i own ..MARINE LAW; BY EDMUND WHELAN categorically states "OWNERSHIP OF THESEABED; AND INDEED THE BED OF ALL TIDAL WATERS...IS VESTED IN THECROWN. simple. but i dont want those buffoon bailiffs down here ... although i dont knowhow they will remove my 130 ton liveaboard cruiser (converted tug boat)... and... i want BITE BACK. advice please. solicitors take note please. they gave me A WEEK 13 feb. and my boat wont even float for ages; not being a big enough tide. it is all insane.

    If bailiffs have turned up then there is more to this, What other documentation have you received prior to their visit.

    (Also a boat owner).

      Very unsettling for you.

      I've had a quick look around and from this document (https://www.torridge.gov.uk/CHttpHan...x?id=13968&p=0) it is clear that Torridge District Council
      is the statutory harbour authority with responsibility for large areas of the estuary.
      The report also states @ 3.23 The bed of the River Torridge and the Estuary (referred to as the fundus) is in mixed ownership.

      I understood that the statement about the Crown ownership of seabed and tidal waters was a truism in any case, as there are several places where the local authority own the seabed following sale by the Crown Estates, or even areas where the Crown may have made a grant (prior to Magna Carta 1215) which alienated the ownership of the bed of a tidal river.

      I think you need to do some research to ascertain who the owner or leaseholder is of the area in which you are moored. It might not be the Crown
