  • Voluntary Termination of Mini

    Seeking some advice on voluntary termination of my Mini.

    I followed the advice on not paying excess mileage fee if I had paid 50% of the cars value and the car was in immaculate condition after 3 years.

    I emailed mini finance to notify them of my decision to VT. The car was collected around 3 months ago. I never signed anything to say that I agreed to paying the excess mileage fee and not did I receive a later about any charges for damage, only a bill for the excess mileage.

    To this his date I have still not paid the fee, however I have received multiple calls and letters from mini finance trying to contact me in order to make me pay.

    More recently I have received a letter from debt collectors stating that they are trying to get in touch with me in relation to my agreement with mini finance.

    At this stage I am unsure how to proceed? Are they just pressuring me into paying or will they take action.

    Does anyone on here have any experience with this or have you been taken to court with this?

    I appreciate any advice on this.

    I am in the same position. I've had an email followed by a letter 3 weeks later. Interestingly the letter says I am in arrears under the Consumer Credit Act 1974 and does not mention the excess mileage at all. The salesman in the mini garage told me they have never taken anyone to court because they know they'll lose and don't want that widespread. But I too am a bit worried about their next step - especially since reading about your threats with the debt collectors!
