  • C P Plus Parking Fine

    Hi, I received the attached parking fine for parking in a MOTO Services for 2hrs 25min on a 2hr limit, CP Plus are charging £100 or £60 if paid within 14 days which is crazy considering the actual parking is £15 for 2-24hrs. Do I have to pay this? the letter seems very vague almost like a scam.

    It's not a fine, it's an invoice for an alleged breach of contract. Edit our post so that the identity of the driver cannot be inferred. Use "the driver ......" etc.

    To be able to hold the keeper liable if they don't know the driver they have to comply with the requirements of Schedule 4 of The Protection of Freedoms Act 2012 , Look in particular at paragraph 9 as there was no windscreen ticket and see how many items they've missed.

    Here's an appeal to send:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    Yours etc



    They will reject your appeal but will give you a POPLA code and you will then win at POPLA because of the many POFA fails

      Can anyone help with this?

      I have received a fine from CP Plus for £100 or £50 if paid within 14 days for a carparking infringement in Walsall. It claims they do not have sufficient evidence that I paid a parking ticket. The cost of the parking ticket was £1. It seems like a huge scam to me. Will I have to pay it?

        First glance i thought the notice to keeper as out of time, thought under schedule 4 para 9 of the POFA 2012 they had to send in 14 days, and that appears to be out of time, if im right of course

          Wish you would start your own thread so that the details don't get confused the original thread and wrong advice gets given. Can you move everything to a new thread.

          The ticket is out of time to hold the keeper liable. There are also several other POFA fails on there.

          Is this a parking ticket forwarded by a hire company?

            Hi,
            i have received a letter that I was got charge of £100 because I was parked in Crown Wharf WS2 8LL,
            for 10 hours and I would like to tell you that I’m working in Smyth toys as a Securiry and I came from Birmingham City Centre so I don’t have any idea about the parking or how it goes and in same time no one even the managers of Smyth an Toys tell me to confirm with the BPA or any side, so please you got all the details and you can ask them to confirm that I’m working with them
            in that time.

              Hi all I recieved a parking fine today from cp plus that states this is the 2nd reminder off them they state they first sent a notice out on 16/10/2019 and a reminder on the 4/11/2019 and then today's dated 21/11/2019 , the one I received today on the 25/11/2019 is the 1st one I have had off them I haven't had any others on the previous dates stated. It says I now have to pay £140 for 29 minutes parking over the allotted free parking. I was driving down to Manchester from Scotland and started to get a migraine and was tired so came off at birch services westbound. I set my alarm for an hour and 45 minutes but overslept due to the migraine when I woke up my head was still hurting and I didnt realise I had gone over but set off again immediately. What can I do? Thank you
