    hi everyone
    I have been caught doing 102 on motorway and wondered if anyone can advise on a mitigation letter of plea, if I loose my licence I loose my job, which then can’t afford my rent and finance in car.
    im 28 yrs old male and never been in trouble with police before.
    i live in West Yorkshire and the offence was Cambridge.
    all advice greatly appreciated.
    offence 05/08/18 and received letter today 19/01/19

    Mitigation is how loosing your licence will affect other. So need to word it so.

    Do you take infirm parents shopping / to doctors - things of this ilk.

      Hi and welcome.

      Have you been summonsed to appear in court or can you enter a postal guilty plea?

      If there were no aggravating factors (e.g. previous convictions, poor weather conditions etc) for just exceeding 100mph your likely ban (if any) is going to be at the bottom end of the guidelines.
      This is a Band C offence for which the guidelines state the court will consider a driving ban of between 7 and 56 days or impose six penalty points. This could be coupled with a fine up to 150% of weekly income.

      In mitigation
      1) apologise
      2) No previous convictions or no relevant/recent convictions
      3)Good character and/or exemplary conduct

      Clearly, any driving ban will cause hardship especially if it means loss of employment. However, where you can demonstrate that the ‘hardship’ is ‘exceptional’ then the court will either decline to disqualify you or reduce the length of the disqualification. For example, if the loss of your employment following a driving ban might lead to the loss of your home, or your children having to be taken out of private education, or your business going under and your employees being made redundant then you might well succeed in persuading the court that you would suffer ‘exceptional hardship’.

        Thank you for your reply, no court date given at moment just a letter and a choice to either plead guilty by post, plead guilty in court or not guilty plea.
        The court hearing would I presume be Cambridge but I just cannot afford to have time of work.

          If you are given the option of pleading guilty by post the chances are you won't be banned!
          If they intend to remove your licence your presence is required in court.
          So if given the chance, postal plea of guilty with admission of what a stupid thing to do, out of character, truly sorry, apologies for wasting court time etc
          Don't say you were tired, or distracted as that makes you appear to be driving without due care and attention!
