    Hi, I have received a single justice procedural notice for speeding which allows me to plead guilty by post. I wish to do this but have no idea how to or what to write in my mitigation letter.
    Details: I am a young driver (26) have only had my licence for just over 2 years and this is the first time caught speeding. I was driving 79 in a 50. I have no excuse for this apart from being stupid and making a mistake i shall never make again.
    Please can someone help? I don't even know who to address the letter to at the start. I feel so ashamed and have no idea how to express that on a piece of paper

    So a band c offence for which the penalty is 6 points and a penalty of around 150% (between 125% and 175%) of your weekly income,
    (as you don't have to appear in court you shouldn't be losing your licence)

    Dear Sir is a good way to start
    mitigating factors relating to the offence itself, are for instance, the defendant's speed was not excessive, there was little traffic around, there was only a momentary lapse in concentration,, and the defendant entered an early guilty plea.

    Mitigation factors relating to the defendant him/herself (and their personal circumstances) include the defendant's youth; any remorse shown; it was a first offence; the defendant's drink was spiked; he was vulnerable; has a clean driving licence, and so on

    As you have admitted (on here anyway) to having no excuse for this apart from being stupid and making a mistake that you will never make again
    I cannot see what mitigating factors you can (truthfully) put forward!!

    What was the "mistake"? not spotting the speed camera? getting caught?.

        Thank you for that. Wouldn’t stating little traffic be an aggravating thing to say?
        Also would it be better for me to appear in court?

          Not if it was true. speeding with lots of traffic around could be considered dangerous

          Not if you don't have to! Only appear in court if required. If you elect to appear in court and then plead guilty you are taking up valuable court time unnecessarily, which is not appreciated by the judiciary!

            Thank you. I assume it is best to do this typed up and include the letter within the form rather than write within the little space provided on the paper work?
