  • Letter of Claim for parking (Scotland)

    Apologies in advance if something similar has been posted and answered.

    I received a parking charge notice for parking. I have taken advice from various posts and different sites to ignore but keep all correspondence, which I have.

    I'm now in receipt of a letter of claim from BW legal stating that I have until 1st February to pay the outstanding amount of they will take me to court. I’ve also discovered that they’ve run a credit search on me.

    I’ve stood my ground so far but when I receive the letter yesterday, I’m now worried as what to do. Do I continue to ignore?

    I am the registered keeper of the vehicle but from advice from here and other sites I thought that these parking charges were not enforceable in Scotland providing that the driver is not identified.

    Any assistance would be appreciated and thanks in advance.

    If you have not responded to any of the previous letters then they are probably hoping that there will be no response to this and therefore a default judgement is in their sights. Respond back stating that you are the keeper of the car in question, with no responsibility for identification of the driver at the time and therefore, as Schedule 4 of The protection of Freedoms Act 2012 does not apply in Scotland. Why are they attempting to take action agaisnt the keeper?

      Is the alleged debt to a Private Company (for example UKPC Ltd) or a Local Authority (i.e. Glasgow City Council).

      If it is to a Council then you are fcuked and need to pay it before Sheriff Officers get involved and arrest your earnings to repay the debt.

      If it is from a private company then just ignore it ad infinitium.
