    Hi

    I have received a letter from Gladstone Solicitors dated 17th December 2018 requesting a payment of £160.00 or reply by 31st December 2018. This letter states that they have sent me a letter prior to this which I have not received.

    I had appealed against the initial penalty charge as my car was broken down and had to park at the residential car park to get help. I had attached my repair receipt with my appeal but was refused. I made a further appeal to IAS which was also unsuccessful.

    Any advise will be highly appreciated

    To obtain any worthwhile advice you need to post up copies of you PCN, the details of your appeal and the letter from Gladstones.(remove identifying details)

    At this stage a quick response to Gladstones advising only that you have not received their earlier letter and require a copy.
    Send first class and get free certificate of posting from PO. on Monday (or email)

      I will reply to Gladstones on Monday also I will post the relevant documents here after that.

        Hi
        I have noticed that on Monday it will be 31st of December 2018. Wont it be too late to send a letter on that day. Gladstone Solicitors do not have email address. I have tried to call them today but with no luck. Will try to call them again on Monday and also send them a letter just in case.

          Try not to phone them in case you drop yourself in. If you read a bit more about the IAS you will find that any appeal will be rejected.

          You may very well have a case for frustration of contract, something that the parking companies or the IAS refuse to recognise because it means they lose money. A court would recognise it. What are they threatening if you don't reply in that time?

          By the way this is not a penalty, it is a speculative invoice.

            Thank you very much for your reply.

            I couldnt make it on time at the post office, didnt realise it will be closed early today. Hence, I registered with Gladstone Solicitors as per their letter suggested and sent them a message which i will upload it here. I did receive an acknowledgement for it by email. I will also upload all the relevant documents later in the first week of the near year.

                  Hi

                  I have not received any reply from Gladstones Solicitors since my reply to them on 31st December 2018.
                  I have attached a letter which I initially appealed the penalty in April 2018. I will be attaching more documents soon after removing the personal details.

                              Hi

                              I have today received county court claim form after all this time. I have 14 days to respond and issue date is 10th June 2019.

                              The particulars of claim are:

                              "The driver of the vehicle with registration ........ (the 'vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract') at ....... on 03/03/2018 thus incurring the parking charge (the 'PCN'). The driver of the vehicle agreed to pay the PCN within 28 days of issue yet failed to do so. The Claimant claims the unpaid PCN from the Defendant as the driver/keeper of the vehicle. Despite demands being made, the Defendant has failed to settle their outstanding liability. THE CLAIMANT CLAIMS £100 for the PCN, £60.00 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £15.20 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.04 per day."

                              Please note that I have never agreed to pay the PCN as mentioned above.
