  • Damage by neighbours builder

A little advice please, theour neighbours wall was damaged and they have called in workmen to replace the wall. The damaged bricks were removed, and they damaged our fence panel which they said they would replace.
The next day they asked to remove this which we agreed, they brought in a digger to remove the foundations, what we had not been aware of was that the wall had been built on our land, as this was behind a 20 ft shed in removing the foundations they dug into our garden leaving a trench about three foot wide and two foot deep. This has gone about a foot under the back of the shed, which has stood for about 40 years, this has caused the floor to slightly. We have been assured that once the wall is rebuilt it will be in the correct position but my concern is that this work is going to take about 4 weeks and I am not sure that our shed will withstand the time not being on secure ground. Would they be liable for a new shed if it subsides?

    Hi & welcome
They will not be liable for a new shed, only to replace the existing shed with one of a similar age and condition.
If that is not possible they would only have to give you its present value.

Assuming this is a wooden shed, and it is 40 years old.........

It may be better, if your shed collapses, to claim under your own insurance if it is on a new for old basis and depending on the excess
