i am in dispute with PRA group who have already issued a ccj against me in 2016. They state that they owned the debt (£980.00, credit card from MBNA) from 2014 as Activ Capitol group (their other name) and then they instructed BCW group to ‘manage’ the debt.
in March 2016 BCW cancelled my payments and I fell into arrears unaware because I had just moved. PRA slapped a ccj on me in July saying I hadn’t paid.
The reason for the arrears was because they claim that BCW group ‘closed down’ and they took over the debt but their paperwork says they already owned it since 2014 so my question is how can PRA group have owned the debt with BCW group ‘managing’ it?
This is not mentioned on the ‘particulars of claim’.
It seems as though they intentionally cancelled my payments to get me into court and give me a ccj and the BCW group closing down was an excuse to cancel my direct debit.
i would really love some expert advice with this one. I really was under the impression that if you pay your debts then you don’t get into trouble in court. I had no idea my £10 a month wasn’t going out.
Any advice?
