  • PCN Highview Parking Treliske Retail Park

    I received the attached PCN from Highview Parking

    I read BOH1066’s recent post and OSTELL’s response. The circumstances are identical except for the line ‘exceeded the maximum stay prominently displayed on the signage at the site’.

    I intend to send OSTELL’s response letter from BOH1066’s post. Could you please tell me if this is applicable for this case? Also, is there a particular date to send the reply to bring to their attention they have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012, so that they will not re-send to the registered keeper complying?

    I will also be writing to the retail companies and retail park owners and agents at Treliske to support others in this situation.

    Ref PCN xxxxx VRM yyyyyy
    I am the registered keeper of the above vehicle and am in receipt of the PCN you issued. I have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to give the warning to the keeper, contrary to section 9 (2) (f) of the Act. You cannot therefore transfer liability from the driver at the time to me.

    There is no legal requirement to identify the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    They have 14 days from the date of the incident to get the letter to the keeper. I think tat is well past.

    They've also failed 9 (2) (e) but that can be kept for use with POPLA, if required

      Yes, this letter. Is it applicable and if yes can I send it now? If so, is it best by recorded post or their online appeal? Many thanks

        Send by post, first class, with a free certificate of posting from any post office. Or as a PDF attachment to an email. You can use their on line appeal page but make sure you appeal as the keeper (it probably defaults to the driver) and take screen prints and save them before you send
