  • Daughter living in our house paying rent but no tenancy agreement

    Some advice sought please...

In August 2017 our daughter and her boyfriend moved into our home as we relocated to Scotland.

No tenancy agreement was put in place and the rent was paid monthly by direct bank transfer from their bank account.

We now have a situation that the couple will not talk or engage with us and no rent is being paid. We have confirmed they are still living at the property and also had confirmation that we are requesting payment.

whilst this is a little early to say what are the rules around needing to take back session in these circumstances

This sounds a complicated and potentialy delicate situation.
I would engage with a solicitor (in England) and get the facts on where you stand. I doubt it would be very expensive, perhaps £60. Maybe even free for the first meeting.

If you illegaly evict/harrass them it could get very expensive.
